These Terms and Conditions ("Terms") govern access to and use of the Ask George websites, applications, portals, software, communications systems, artificial-intelligence features, databases, services, and related technology platforms operated by Ask George, LLC ("Ask George," "George," "we," "us," or "our"), including askgeorgenow.com and any related application or service (collectively, the "Platform").
PLEASE READ THESE TERMS CAREFULLY. BY CREATING AN ACCOUNT, ACCEPTING AN INVITATION, CLICKING "I AGREE," ACCESSING THE PLATFORM, OR USING ANY ASK GEORGE SERVICE, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS.
IF YOU DO NOT AGREE, DO NOT CREATE AN ACCOUNT OR USE THE PLATFORM.
1. Mandatory Account Acceptance
No user may create or activate an Ask George account without affirmatively accepting these Terms and acknowledging and agreeing to the Ask George Privacy Policy.
Ask George may record evidence of acceptance, including user identity, account and organization, version of the Terms accepted, version of the Privacy Policy accepted, date and time, IP address, device or browser information, and method of acceptance.
Ask George may require users to re-accept revised Terms or policies before continued use of the Platform.
2. Eligibility and Authority
You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to create an account.
If you use the Platform on behalf of a builder, subcontractor, vendor, consultant, property owner, employer, homeowner, organization, or other entity, you represent and warrant that you are authorized to act for that entity, accept these Terms on its behalf where applicable, provide accurate information, and upload or share the materials you provide.
3. Nature of Ask George
Ask George is a software-enabled property, construction, warranty, maintenance, coordination, data, analytics, and administrative services company.
Depending on the applicable service, George may assist with construction project administration, budgets and estimating, bid solicitation and comparison, subcontractor coordination, scheduling, document management, plans and specifications, RFIs and submittals, selections and approvals, procurement, bills and accounting workflows, closeout, warranty coordination, property information management, maintenance planning, service coordination, analytics, and AI-assisted workflows.
Unless expressly agreed otherwise in a separate written agreement, Ask George is not a general contractor, construction manager of record, architect, engineer, licensed trade contractor, inspector, code official, lender, accountant, attorney, insurance provider, fiduciary, emergency service, medical provider, or caregiver.
4. Additional Role-Specific Agreements
Certain users may also be subject to separate Builder, Homeowner, Subcontractor, Consultant, Membership, ordering, pricing, warranty-management, or other agreements.
These Terms govern Platform use unless a separate signed agreement expressly provides otherwise. If a separate agreement conflicts with these Terms regarding a specific paid service, the separate agreement controls that service.
5. Accounts and Security
You are responsible for maintaining login confidentiality. You may not share personal credentials, permit unauthorized use, impersonate another person, access information outside your role, or attempt to bypass security controls.
Ask George may require multi-factor authentication and may suspend access to protect users, property information, confidential information, or the Platform.
6. Property-Centered Records
Ask George is designed around persistent property and project records.
Information may remain associated with a property across construction, settlement, warranty, maintenance, repair, renovation, changes in service providers, and ownership changes.
Access may change based on role, organization, project relationship, property relationship, ownership period, entitlement, trade assignment, workflow assignment, information classification, and applicable law.
The existence of information in George does not mean every participant associated with a property may see it.
7. Ownership of the Platform
Ask George owns all right, title, and interest in the Platform, including software, source code, databases, schemas, workflows, interfaces, designs, business logic, prompts, templates, algorithms, models, scoring systems, taxonomies, processes, analytics, reports, compilations, documentation, trademarks, branding, and proprietary methods.
Except for the limited right to use the Platform, no rights are transferred to any user.
8. Data, Property Records, Media, and Work Product
To the maximum extent permitted by law, and as between you and Ask George, Ask George owns the Platform-generated and compiled data layer associated with use of the Platform, including Property Records, Project Records, structured property information, classifications, metadata, normalized data, extracted information, analytics, derived data, performance data, scorecards, benchmarks, inferences, data relationships, AI-generated summaries, workflow histories, audit information, reports, and system-generated work product.
"User Materials" means information or materials submitted, uploaded, forwarded, recorded, transmitted, or otherwise provided by a user, including plans, drawings, specifications, bids, proposals, invoices, contracts, schedules, photographs, videos, recordings, messages, manuals, warranties, field reports, selections, project documents, service records, and other data or materials.
To the extent you own assignable rights in User Materials, you assign to Ask George, to the maximum extent legally permitted, all right, title, and interest necessary for Ask George to possess, reproduce, organize, modify, structure, analyze, derive information from, incorporate into the Property Record, and otherwise use those materials in connection with Ask George's business.
To the extent a right cannot legally be assigned, you grant Ask George a perpetual, irrevocable, worldwide, royalty-free, fully paid, transferable, sublicensable, nonexclusive license to host, store, copy, reproduce, modify, adapt, process, translate, analyze, organize, create derivative works from, aggregate, deidentify, commercialize, license, transfer, distribute, display, and use User Materials for operation, improvement, development, analytics, research, benchmarking, artificial intelligence, property services, and other lawful business purposes.
These rights survive termination. Nothing transfers rights you do not possess. You represent that you have authority to provide User Materials and grant the rights described above.
9. Personal Information and Statutory Privacy Rights
The ownership and license provisions do not eliminate rights that cannot legally be waived under applicable privacy law.
Personal information is handled as described in the Privacy Policy.
Deletion of personal information does not necessarily require deletion of non-personal property facts, deidentified or aggregated data, records Ask George is legally entitled or required to retain, records needed for contracts, disputes, security, fraud prevention, audit, accounting, or legal obligations, information belonging to another party, or independently obtained information.
10. Confidential Commercial Information
The Platform may contain sensitive commercial information including subcontractor pricing, vendor pricing, unit costs, bids, contract values, discounts, invoice amounts, builder budgets, builder margins, project profitability, internal estimates, and financial assumptions.
Access is governed by Platform permissions.
A subcontractor's technical specification may be appropriately shared while that subcontractor's confidential bid price remains restricted.
Unless separately authorized, homeowners may not access subcontractor or vendor cost; subcontractors may not access another trade's pricing; consultants may not access confidential financial information solely because they have technical access; users of one builder may not access another builder's confidential information; and builder personnel may receive only the financial access their organization grants.
Users may not copy, scrape, publish, export, exploit, or use another party's confidential commercial information outside authorized purposes.
Ask George may use confidential commercial data internally for Platform operation, fraud and error detection, project administration, analytics, forecasting, benchmarking, pricing intelligence, product improvement, AI/model development, and aggregated or deidentified commercial insights.
11. Artificial Intelligence and Automated Features
The Platform may use AI, machine learning, OCR, natural-language processing, image analysis, and other automated technologies for document classification, extraction, estimating, scheduling, bid comparison, risk identification, maintenance recommendations, warranty routing, issue intake, summarization, communications, and forecasting.
AI-generated information may be incomplete or wrong. Users must review material information before relying on it.
Ask George may use Platform data and User Materials to develop, test, evaluate, improve, and operate Ask George AI systems and related products, subject to applicable law and confidentiality obligations.
12. Builders and Construction Users
Builders and construction professionals remain responsible for construction means and methods, jobsite safety, code compliance, permits, inspections, subcontractor supervision, contract administration, scope review, cost review, schedule decisions, quality, workmanship, and legal compliance.
A George workflow, alert, checklist, recommendation, or record does not make Ask George responsible for construction supervision or acceptance of work.
13. Subcontractors, Vendors, and Consultants
Subcontractors, vendors, consultants, and other third-party professionals remain independently responsible for licensing, insurance, employees, taxes, safety, means and methods, professional services, workmanship, code compliance, environmental compliance, warranties, and contractual obligations.
Ask George does not guarantee their performance.
14. Homeowner Construction Decisions
Homeowners may use George for selections, allowances, approvals, change orders, project updates, warranty requests, and property information.
The builder controls builder pricing and the contractual relationship with the homeowner. Where George displays an allowance, builder price, upgrade, credit, or change-order amount, it reflects information supplied or approved by the builder.
Homeowner approvals recorded through the Platform may constitute binding electronic approvals where permitted by applicable agreements and law.
15. Warranty Coordination
Ask George may assist with administrative warranty coordination. Unless expressly stated otherwise, Ask George does not issue the builder's warranty, independently expand coverage, guarantee claim coverage, guarantee trade performance, or guarantee repair outcomes.
AI may assist in identifying likely responsibility or relevant property information, but final warranty coverage decisions requiring human judgment are not made solely by automated systems.
16. Property and Site Access
Users may provide keys, lockbox information, alarm information, gate codes, smart-access credentials, or other access information where authorized.
Ask George may facilitate access but is not a custodian, bailee, security company, or insurer.
17. Communications and Electronic Records
You consent to electronic communications relating to your account and Platform use, including invitations, approvals, schedule notices, security notices, billing notices, warranty communications, and policy updates.
Electronic records and approvals may have the same force as paper records and signatures where permitted by law.
18. Payments, Fees, and Subscriptions
Fees, subscriptions, service charges, membership terms, cancellation terms, and payment responsibilities are governed by applicable ordering pages, service agreements, invoices, or other written agreements.
Builder construction bills managed through George may be approved and transmitted to systems such as QuickBooks while actual vendor payment remains the builder's responsibility unless expressly agreed otherwise.
19. Third-Party Integrations
The Platform may integrate with accounting software, payment processors, email, cloud storage, mapping services, AI providers, communications providers, and analytics tools.
Use of third-party services may also be subject to their terms.
20. Prohibited Uses
You may not access the Platform without authorization, defeat authentication or permissions, scrape or harvest Platform data, introduce malware, interfere with operation, upload materials you have no right to provide, misuse confidential information, impersonate another user, falsify project/warranty/invoice/compliance information, use the Platform unlawfully, or misuse AI functionality.
21. Availability and Changes
Ask George may add, remove, change, suspend, or discontinue features, workflows, integrations, pricing, and access levels and does not guarantee uninterrupted or error-free availability.
22. Suspension and Termination
Ask George may suspend or terminate an account or organization for violation, nonpayment, security risk, misuse, fraud, unauthorized access, legal requirements, or termination of the applicable commercial relationship.
Termination does not require destruction of underlying Property Records, Project Records, audit history, analytics, or other information Ask George may lawfully retain.
23. No Professional Advice
George provides administrative and informational support unless expressly identified otherwise. Nothing constitutes legal, accounting, tax, engineering, architectural, medical, insurance, financial, or other regulated professional advice.
24. Not an Emergency Service
Ask George is not an emergency-response service. For immediate threats to life, health, property, or safety, contact 911, the fire department, gas utility, or appropriate emergency provider.
25. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." ASK GEORGE DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, AND RELIABILITY.
ASK GEORGE DOES NOT WARRANT THAT INFORMATION OR AI OUTPUT WILL BE ERROR-FREE, A CONTRACTOR WILL PERFORM SATISFACTORILY, A PROJECT WILL MEET BUDGET OR SCHEDULE, A WARRANTY CLAIM WILL BE COVERED, A SERVICE WILL PREVENT DAMAGE, OR DATA WILL NEVER BE LOST OR ACCESSED WITHOUT AUTHORIZATION.
26. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASK GEORGE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, REVENUE, BUSINESS, OPPORTUNITIES, OR DATA; DELAYS; COST OVERRUNS; THIRD-PARTY WORKMANSHIP; OR THIRD-PARTY MISCONDUCT.
ASK GEORGE'S AGGREGATE LIABILITY WILL NOT EXCEED FEES ACTUALLY RETAINED BY ASK GEORGE FROM THE CLAIMING PARTY FOR THE APPLICABLE SERVICE DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IF NO FEES WERE PAID BY THE CLAIMING PARTY, AGGREGATE LIABILITY WILL NOT EXCEED $100 EXCEPT WHERE LAW REQUIRES OTHERWISE.
27. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Ask George and its affiliates, members, managers, employees, contractors, agents, successors, and assigns from claims, liabilities, damages, losses, expenses, and reasonable attorneys' fees arising from your use of the Platform, User Materials, violation of these Terms or law, construction/trade activities, employees/subcontractors, decisions/approvals, unauthorized disclosure, or infringement of third-party rights.
28. Dispute Resolution and Binding Arbitration
Except for matters eligible for small-claims court or requests for temporary injunctive relief concerning unauthorized access, intellectual property, confidentiality, or misuse of data, disputes arising from these Terms, the Platform, an account, use of Ask George, or the relationship between you and Ask George will be resolved through mandatory binding arbitration to the maximum extent permitted by law.
Arbitration will take place in Fairfax County, Virginia, or remotely if Ask George agrees or applicable law requires.
Disputes must be brought on an individual basis. Class, collective, representative, and consolidated proceedings are waived to the maximum extent permitted by law.
Each party waives jury trial to the maximum extent permitted by law.
29. Governing Law
These Terms are governed by Virginia law without regard to conflict-of-law principles, except where applicable law requires otherwise.
30. Changes to These Terms
Ask George may revise these Terms. Material changes may require renewed affirmative acceptance before continued use.
31. Assignment
You may not assign your rights without Ask George's written consent. Ask George may assign or transfer these Terms in connection with an affiliate, financing, merger, acquisition, reorganization, sale of assets, or transfer of the Platform or business.
32. Severability
If a provision is invalid or unenforceable, it will be enforced to the maximum extent permitted and the remainder remains effective.
33. No Waiver
Failure to enforce a provision does not waive later enforcement.
34. No Third-Party Beneficiaries
Unless expressly stated otherwise, these Terms create no third-party rights.
35. Entire Agreement
These Terms, the Privacy Policy, and applicable role-specific/service-specific written agreements govern use of Ask George.
